3. Consumer and business customers
A consumer is someone purchasing goods wholly or mainly for purposes outside their trade, business, craft or profession.
A business customer is someone purchasing goods wholly or mainly for use in connection with a trade, business, craft or profession.
Certain provisions of these terms apply only to business customers. These are clearly identified.
4. Product information
We take reasonable care to ensure that product descriptions, specifications, dimensions, photographs and prices are accurate.
Product photographs are for illustration. Colours and finishes may vary slightly because of manufacturing processes, materials, lighting and screen settings.
Measurements and weights may be approximate unless expressly stated otherwise.
We may make minor changes to a product where these do not materially affect its quality, function, safety or fitness for its stated purpose.
5. Product suitability and compatibility
Sweepertec products are intended for use with appropriate industrial machinery and equipment.
Before ordering and using a product, you must check:
- the dimensions and capacity of the carrying machine;
- fork dimensions and spacing;
- lifting capacity and safe working load;
- the intended application and operating environment;
- access, clearance and manoeuvring requirements; and
- that the product is suitable for the materials being swept.
Please contact us before ordering if you are uncertain about compatibility.
Information provided by us does not replace the machine manufacturer’s instructions, a site-specific risk assessment or the judgement of a suitably trained and competent operator.
This section does not remove any rights a consumer has where goods are faulty, misdescribed or unfit for a purpose made known to us.
6. Placing an order
Your order is an offer to purchase the goods shown in your basket.
After you place an order, you may receive an automated acknowledgement. This confirms that we have received the order but does not necessarily mean that it has been accepted.
A contract is formed when we send you a further written confirmation that the order has been accepted, which may be included in a dispatch confirmation.
We may refuse or cancel an order before acceptance where:
- a product is unavailable;
- a price or product description contains an obvious error;
- payment cannot be authorised;
- we cannot deliver to the address provided;
- we reasonably suspect fraud or misuse; or
- supplying the product would be unlawful or unsafe.
Where payment has already been taken for an order that we do not accept, it will be refunded.
7. Order information
You are responsible for ensuring that:
- your name, address, telephone number and email address are accurate;
- the delivery address is complete and accessible;
- products and quantities are correct;
- any compatibility information you provide is accurate; and
- you are authorised to place the order on behalf of a business where applicable.
Please contact us promptly if you notice an error. We cannot guarantee that an order can be amended once manufacturing, picking or dispatch has begun.
8. Prices and VAT
The price payable is the price shown at checkout when the order is placed.
Applicable VAT and delivery charges will be displayed before you complete your purchase.
If we discover an obvious pricing error before accepting an order, we will contact you. You may confirm the order at the correct price or cancel it for a full refund.
Prices and promotions may change without notice, but changes will not affect orders that have already been accepted.
9. Payment
Payment must be made using one of the payment methods offered at checkout.
Goods will not normally be dispatched until cleared payment has been received unless an approved business credit account has been agreed separately.
You confirm that you are authorised to use the payment method supplied.
Business credit accounts
Where we approve credit terms for a business customer, payment must be made by the due date stated on the invoice.
We may suspend further deliveries or withdraw credit facilities where an invoice is overdue.
We reserve the right to claim statutory interest, fixed compensation and reasonable debt-recovery costs on overdue qualifying business debts in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 and associated legislation.
10. Delivery
Delivery is governed by our Shipping Policy.
Delivery dates are estimates unless we expressly agree a guaranteed date in writing.
For consumer orders, unless another timeframe has been agreed, we will deliver the goods without undue delay and normally within 30 days after the contract is formed.
Large Sweepertec products may require pallet freight, suitable vehicle access and appropriate unloading facilities.
11. Risk and ownership
Consumer purchases
Where we arrange delivery to a consumer, the goods remain at our risk until they come into the physical possession of the consumer or a person nominated by them.
Where the consumer independently appoints a carrier that we did not offer, risk may pass when the goods are handed to that carrier.
Business purchases
Unless otherwise agreed in writing, risk in goods supplied to a business customer passes when:
- the goods are handed to the carrier for delivery;
- the business customer or its carrier collects them; or
- delivery is otherwise completed in accordance with the agreed delivery terms.
Ownership of goods supplied on business credit terms remains with us until all sums due for those goods have been paid in full.
Until ownership passes, the business customer must:
- keep the goods identifiable;
- protect and insure them appropriately;
- not create any charge or security over them; and
- allow us reasonable access to recover them following non-payment, where legally permitted.
12. Inspection and use
You should inspect the goods promptly after delivery.
Before operating a Sweepertec product, the customer must ensure that:
- it is compatible with the machine;
- it is correctly fitted and secured;
- all retainers and safety devices are correctly installed;
- the machine and attachment remain within their rated capacities;
- the operator is trained and competent; and
- all instructions, risk assessments and workplace safety procedures are followed.
Do not use a product that appears damaged, incorrectly assembled or unsuitable.
Using a product may materially reduce its resale value. Please read our Returns and Refund Policy before fitting or operating it.
13. Returns and cancellations
Returns, consumer cancellation rights, business handling charges, used goods and return-freight costs are governed by our Returns and Refund Policy.
Consumers normally have 14 days after receiving eligible goods to notify us that they wish to cancel and a further 14 days to return them.
Business customers do not have an automatic right to return correctly supplied goods. Authorised business returns are subject to the conditions and charges stated in our Returns and Refund Policy.
14. Bespoke and special-order products
Products made to a customer’s specifications, customised products and certain special-order products may not be cancellable or returnable unless faulty or incorrectly supplied.
We may require full or partial payment before beginning manufacture or ordering special materials.
Once manufacture or procurement has begun, a business order may only be cancelled with our written agreement and may be subject to the costs we have reasonably incurred.
15. Faulty, damaged or incorrect goods
Please contact us promptly if goods arrive:
- damaged;
- defective;
- incomplete; or
- different from those ordered.
We may request photographs, measurements, serial numbers or other reasonable information to investigate the issue.
Where appropriate, we may arrange inspection, repair, replacement, collection, refund or another lawful remedy.
Nothing in these terms limits a consumer’s statutory rights relating to goods that are faulty, not as described or not fit for purpose.
16. Business warranties and liability
This section applies only to business customers.
We warrant that goods will materially conform to their stated specification at the time of delivery.
We are not responsible for loss or damage caused by:
- incorrect product selection;
- incompatibility with the carrying machine;
- overloading;
- improper fitting or operation;
- unauthorised modification or repair;
- failure to follow instructions;
- normal wear and tear;
- misuse, abuse or neglect; or
- use in an application for which the product was not designed.
To the fullest extent permitted by law, we will not be liable to a business customer for:
- loss of profit;
- loss of revenue;
- loss of business;
- loss of anticipated savings;
- loss of contracts;
- loss of production;
- loss of goodwill; or
- indirect or consequential loss.
Subject to the exclusions below, our total liability arising from an order will not exceed the price paid for the goods giving rise to the claim.
Nothing in these terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- defective products where liability cannot lawfully be excluded; or
- any other liability that cannot legally be excluded or limited.
17. Events beyond our reasonable control
We will not be responsible for delay or failure caused by circumstances beyond our reasonable control, including:
- severe weather;
- fire, flood or natural disaster;
- transport or carrier disruption;
- industrial action;
- power, telecommunications or systems failure;
- shortages of materials;
- governmental restrictions;
- war, civil unrest or terrorism; or
- disruption affecting suppliers.
We will contact affected customers where reasonably possible and take reasonable steps to minimise delay.
A consumer’s statutory rights relating to serious or prolonged delivery delays remain unaffected.
18. Intellectual property
Unless stated otherwise, all website content—including designs, drawings, text, photographs, product names, graphics and logos—is owned by or licensed to Brush Technology Limited.
You may view and print website content for personal or internal business use.
You must not reproduce, modify, distribute, sell or commercially exploit website content without our prior written permission.
Purchasing a product does not transfer any intellectual-property rights in that product, its design or associated documentation.
19. Acceptable use
You must not:
- use the website unlawfully;
- attempt to interfere with its security or operation;
- introduce viruses or malicious code;
- attempt unauthorised access to accounts or systems;
- scrape or copy substantial website content without permission;
- provide false or misleading information; or
- use the website to infringe another person’s rights.
We may suspend access or cancel an order where we reasonably believe the website is being misused.
20. Third-party services and links
The website may use or link to third-party services, including payment providers, delivery providers and Shopify.
We are not responsible for the content or availability of independent third-party websites. Your use of a third-party service may also be governed by that provider’s terms.
21. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in effect.
22. Waiver
A delay or failure by us to enforce a right does not mean that the right has been waived.
23. Governing law
These terms and any contract between us are governed by the laws of England and Wales.
Consumers resident elsewhere in the United Kingdom retain any mandatory protections and rights available under the laws applicable to them.
Business customers agree that the courts of England and Wales will have exclusive jurisdiction over disputes arising from these terms or an order.
24. Changes to these terms
We may update these Terms of Service from time to time.
The terms applying to an order are those in effect when the order is placed, unless a change is required by law.
